OVERVIEW

Welcome to Coueddles (“Coueddles”, “we”, “us”, “our”). These Terms of Service (“Terms”) apply to your access to and use of our website, online store, and related services (together, the “Services”).
Our store is hosted on Shopify, which provides the e-commerce platform that allows us to sell our products to you.

By visiting our site, browsing, or purchasing from us, you agree to these Terms and any policies referenced on our website (including our Returns Policy and Privacy Policy).
If you do not agree, do not use the Services.

1. ACCESS AND ACCOUNTS

By using the Services, you confirm you are at least the age of majority where you live, or you have permission from a parent/guardian to use the Services.
You may need to provide information such as your email address and shipping/billing details when placing an order, and you agree the information you provide is accurate, current, and complete.
You’re responsible for maintaining the confidentiality of any account login details and for all activity under your account.

2. OUR PRODUCTS

We sell physical printed products (A0 poster, year-at-a-glance calendar posters).
We do our best to display product colours and images accurately, but colours may vary depending on your device/screen settings.
We may update product details, pricing, or availability at any time, and we may limit quantities or discontinue products.

3. ORDERS, ACCEPTANCE & CANCELLATIONS

When you place an order, you’re making an offer to purchase, and we may accept or decline an order (for example, due to stock availability, suspected fraud, or address issues).
An order is only accepted once we confirm it (for example, by email confirmation) and payment has been processed.
If you need to request a change or cancellation, contact us as soon as possible at coueddles@gmail.com, noting we can’t guarantee changes or cancellations once an order has been processed or dispatched.

Returns are handled only in accordance with our Returns Policy published on our website.

4. PRICING, TAXES & CHARGES

Prices are shown in AUD unless stated otherwise, and may change without notice.
Shipping costs are shown at checkout.
For international orders, you may be responsible for customs duties, import taxes, or local fees charged by your country, unless we explicitly state otherwise.

5. SHIPPING & DELIVERY

We ship internationally, and delivery timeframes shown at checkout are estimates and are not guaranteed.
We aren’t responsible for delays caused by carriers, customs, weather, or events outside our control.
If tracking shows your parcel was delivered but you can’t locate it, contact the carrier first and then email us at coueddles@gmail.com so we can assist where possible.

6. RETURNS & REFUNDS

Our returns and refunds are set out in our Returns Policy published on our website.
Nothing in our Returns Policy or these Terms is intended to exclude any rights you may have under the Australian Consumer Law (ACL).
Consumer guarantees apply automatically and cannot be excluded by contract terms.

7. INTELLECTUAL PROPERTY

All content on the Services (including product designs, images, text, graphics, logos, and site content) is owned by Coueddles or used with permission and is protected by intellectual property laws.
You may use the Services for personal, non-commercial use only, and you must not copy, reproduce, distribute, sell, or exploit any portion of the Services or content without our written permission.

8. OPTIONAL TOOLS & THIRD-PARTY SERVICES

We may provide access to third-party tools or services (for example, apps or integrations), and your use of them is at your own risk.
We aren’t responsible for third-party tools/services, their availability, or their actions.

9. THIRD-PARTY LINKS

Our Services may include links to third-party websites, and we aren’t responsible for third-party content, policies, or practices.
If you choose to access third-party sites, you do so at your own risk.

10. RELATIONSHIP WITH SHOPIFY (DO NOT REMOVE)

Coueddles is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Coueddles. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Coueddles, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Coueddles.

11. PRIVACY

Our Privacy Policy explains how we collect, use, and share personal information and is published on our website.
Shopify may also collect and process information to provide and improve the Services, under Shopify’s Privacy Policy (https://www.shopify.com/legal/privacy/app-users).[1]

12. FEEDBACK & REVIEWS

If you submit reviews, feedback, suggestions, or other content (“Feedback”), you grant us a worldwide, royalty-free right to use it for operating and promoting our Services (for example, using a review on our website or social media).
You confirm your Feedback is your own (or you have permission to share it) and does not violate the rights of others.

13. ERRORS & CORRECTIONS

We may correct errors, inaccuracies, or omissions (including in product descriptions, pricing, promotions, shipping charges, or availability) at any time, including after an order is placed.
If a change affects your order, we’ll take reasonable steps to contact you using the details you provided.

You agree not to misuse the Services, including by breaking laws, infringing rights, interfering with site security, or attempting to introduce malicious code.
We may suspend or terminate access if we reasonably believe you have violated these Terms.

15. TERMINATION

Sections that should reasonably survive termination will continue to apply.

Where liability cannot be excluded under the ACL, our liability is limited to the extent permitted by law.

You agree to indemnify and hold harmless Coueddles, Shopify, and our respective affiliates, employees, and service providers from claims or losses arising from your breach of these Terms or misuse of the Services.

19. SEVERABILITY

If any part of these Terms is found unlawful or unenforceable, the rest remains in effect.

20. ENTIRE AGREEMENT

These Terms, together with the policies referenced on our website (including the Privacy Policy and Returns Policy), form the entire agreement between you and Coueddles regarding the Services.

21. GOVERNING LAW

These Terms are governed by the laws of Western Australia, Australia, and you submit to the courts of Western Australia, Australia, noting this does not limit any mandatory consumer rights that may apply.

22. CHANGES TO THESE TERMS

We may update these Terms from time to time by posting a new version on our website.
Changes apply from the date they are posted, unless stated otherwise.
